>> family, friends and well wisher gather to say goodbye to a 13-year-old murder victim while her accused killer answers charges in court. amy is live in fairfield. >> the arraignment was supposed to happen last week but poet pointed because the defense needed more time and now scheduled for today. also today is the victim's funeral. a public funeral will be held today if janell conway allen at the benicia cemetery. the body was found three weeks ago in the park. she was last seen getting off the school bus. police have not said what they think the motive was. they do believe anthony lamar jones killed her. he is also accused of kidnap willing, lewd acts on a child, and rape and he could get the death penalty if convicted but

decision today. if it is any indication how he is leaning the judge has been asking questions this morning about oscar pistorius prior violent behavior including firing a gun in a restaurant. the defense maintained he is not a flight risk. the lead investigator for the prosecution being charged with seven counts of attempted murder is a blow to the credibility of the premeditated murder case. he is facing those charges and is accused of shooting at a minivan in 2011 and his court appearance is scheduled for may. the prosecution is saying they didn't know about it. on "good morning america", they are saying his creditability is key because he is testify about the ballistics. >> it is important as to premeditation, were the bullets coming from above and he could be wearing his legs or below which means his story which he wasn't wearing them. all very important questions because premeditation is crucial with regard to this bail.

could be linked to the killings. >> berkeley police looking for three women who attacked two other women near the cal campus on friday night near prospect street. the two female victims were walking down the street and three other women tried to problem them. the victims tried to run appear but the attackers grabbed a victim, punched her in the face, and knocked her to the backgrounds and used upper spray and a male passerby and the attackers ran off. the victims are okay and anyone with information is asked to call the berkeley police. in san francisco a rally is planned at city college of san francisco and members of the save city college of san francisco coalition want the board of trustees to reverse cuts to class and services, staff and faculty saying the board refused to include them in discussions on the accreditation and budget crisis that the school has been undergoing since last few. >> also in san francisco today a board supervisors committee is set to consider two gun control measures proposed by the mayor

to san jose. major league baseball is respond ing. what is the league doing, cornell? >> if you like the sound of the san jose a's it could be good news. four years ago, the a's made it clear they want to move to san jose. folks at city hall have been trying to make that happen since then. major league baseball is giving the deal a tentative green light to play ball. "los angeles times" is told that baseball commissioner has provided them with tentative guidelines for a potential move to san jose but it doesn't mean this is a done deal but if the a's can satisfy concerns of the league office, the commissioner may let club owners approve the move. the a's have already pledged to pay for a $500 million ballpark in downtown san jose. major league baseball's biggest concern likely the fact that the giants still hold territory rights to san jose and don't

accused of shooting at a van back in 2011 and the court appearance is scheduled for may. the prosecution this morning say they do not know anything about it. it is a blow to the merits of the premeditated murder case as our legal appear list -- analyst explains because he is an expert on ballistics which could show premeditation. if the judge believes there is premeditation it will be hard for oscar pistorius to get bail. the defense says there is in proof of murder here and an interesting point that came up this morning, the prosecution has implied that reeva steenkamp was in the bat room with the door locked because she was hiding in fear from oscar pistorius but the defense is refuting that saying she locked the door after oscar pistorius yelled there was an intruder in the house and the judge asked, wouldn't reeva steenkamp have called out after hearing that wanting from oscar pistorius.
